Terms and Conditions

By participating in the Nature’s Way Dance with The Vita Gummies Contest (“Contest”), you (“Participant”) agreed to be bound by the following terms and conditions: –

1.Organizer and Eligibility

The Contest is organized by PharmaCare (Asia) Sdn Bhd (“Organizer”) and is open to all Malaysian residents aged 18 and above (as of the year 2021) with a valid Instagram account, except for the employees of the Organizer, including its subsidiaries, their immediate family members, their business partners, affiliated companies, suppliers/distributors, promotion/ advertising/ public relations agencies and other parties involved in this Contest.

By participating in this Contest, you agree to comply with these terms and conditions. ‘Organizer’ reserves the right to terminate the Contest at any time without prior notice. PharmaCare (Asia) Sdn. Bhd. shall not be liable for any loss, damage or expense as a result. ‘Organizer’ reserves the right to change, amend, delete or add to these Contest Terms and Conditions without prior notice at any time. ‘Participant’ agrees to be bound to any such changes. The Organizer’s decision shall be final and binding. No correspondence shall be entertained once the decision is final.

2. Contest Period

Contest starts on 15^th August 2021, and ends on 15^th October 2021, 23:59hr (“Contest Period”) on Watsons Malaysia and Nature’s Way Malaysia Instagram page.

3. How to Participate

‘Participant’ must fulfil the below criteria to stand a chance to win the contest:

1) Follow Nature’s Way Malaysia (https://www.instagram.com/naturesway.my/) & Watsons Malaysia (https://www.instagram.com/watsonsmy/) on Instagram

2) Post an Instagram Story of your child/children dancing with the Nature’s Way Kids A+ Epic Tales with Vita Gummies IG Filter (https://www.instagram.com/ar/931395537437776/)

3) Mention @naturesway.my & @watsonsmy on your story and hashtag #DanceWithVitaGummies & #WatsonsMalaysia

4. Winners and Prizes

a) There will be a total of 5 WEEKLY WINNERS to be selected in this Contest.

b) Winners’ selection: –

· All qualified entries will be subjected through a selection process determined by the management, subject to fulfilment of the above-mentioned requirements.

c) Prizes: –

– ONE (1) RM50 Watsons Malaysia Voucher (valid for all products available on Watsons Malaysia E-Store Platform: https://www.watsons.com.my/)

– ONE (1) Nature’s Way Kids A+ Vita Gummies Stationery Box

– Additional: First 30 Participants of Nature’s Way Dance with The Vita Gummies that provide Proof of Purchase of Nature’s Way Products from Watsons Malaysia will receive Nature’s Way Kids A+ products worth RM80* 

d) FIVE (5) winners will be chosen at the end of each week. Final weekly entry is every Saturday, the new week commences on Sundays (example: Week 1 begins 15^th August 2021, ends 21^st August 2021. Week 2 begins on 22^nd August 2021 and so forth).

e) There will be a total of TWO (2) Winner Announcements throughout the Contest Period published on Nature’s Way Malaysia Instagram page. First Winner Announcement will be published on 20^th September 2021, containing winners of Weeks 1- 5. The second Winner Announcement will be published on 20^th October 2021, containing winners of Week 6-9.

f) The winners will be contacted via Personal Message from Nature’s Way Malaysia Instagram page for the following details:

· Full name

· Contact number

· Mailing address

g) If a response is not received within seven (7) days from the winner announcement date, the prize will be forfeited.

h) Upon submission of details by the winner, prizes will be delivered to the mailing address provided by the winners. 

i) The Organizer makes no warranties or representations whatsoever with respect to the prizes and will not be responsible nor liable for any problems and/or damage thereto or arising therefrom.

j) The Organizer reserves the right to replace the said prize with another of equal or lesser value.

k) By participating in this Contest, Participants agree and have given the Organizer the rights to publish and/or display particulars and/or photos of winners in print media and electronic media for the purpose of advertising, publicity and winner announcement without any royalty and/or compensation. Winners hereby irrevocably agree and give consent to the Organizer to publish any related matter to the entries including and not limited to the Winners’ names, interviews, videos and photographs for current and future advertising and promotional purposes.

l) The Organizer is not responsible for Internet connection errors that may affect the contest.

m) If the prize is unavailable for any reason whatsoever, the Organizer reserves the right, at its sole discretion, to provide an alternative prize without prior notice. The prize is not redeemable for cash, not transferable and will only be given to the winner who is able to satisfy all the requirements as set out in the Terms and Conditions.

5. Liability

The Organizer will not be responsible or liable for:

a) Any problem, damage or loss of whatsoever nature to any Participant, or their authorized representatives resulting from their participation in the Contest.

b) Any error (including error in notification of Contest winner), omission, interruption, deletion, defect, delay in operation or transmission, Internet line failure, theft, destruction of, or unauthorized access to entries, PC suspended whether or not arising during operation or transmission as a result of server functions, viruses, bugs or other causes outside its control.

6. Disqualification

The Organizer reserves the right at its sole discretion to disqualify anyone deemed to be tampering with the entry process or the operation of the Contest, to be acting in breach or potential breach of these Contest Terms and Conditions and/or the Organizer. Terms of Use Agreement. No correspondence shall be entertained.

7. Disclaimer

The ‘Organizer’ receives and processes your personal data in accordance with our privacy policy and the PDPA when you provide personal data to this ‘Contest’.

The Organizer may transfer personal information (including but not limited to, name, address, contact numbers) to the service provider(s) for the purposes of administering the Contest and contacting Participants, solely for this Contest only. ‘Participant’ acknowledges and have agreed to our terms and conditions upon participation in the contest by allowing the Organizer in collecting, using, and processing your personal data in accordance with our privacy policy and the PDPA for the following purposes:

• Sending information related to online promotions, contests, and events, and related to our marketing activities, unless you have indicated to us that you do not wish for us to process your personal data for such purposes;

• Using information for marketing and statistical analysis for planning and demo-graphical use;

• Complying with local law and regulatory requirements or to assist in law enforcement and investigations by relevant authorities;

• Any other purposes related to our marketing activities.

DATA PROTECTION AND PRIVACY POLICY NOTICE

Your personal data including your name and contact details (“Personal Data”) which you have provided to PharmaCare (Asia) Sdn. Bhd. (hereinafter referred to as “Organizer”) in your application to participate in the Dance with The Vita Gummies (“Contest”) will be recorded, stored or otherwise processed by us for purposes relating to the administration of the Contest and for related advertising, publicity, marketing and our other legitimate business purpose (“Purpose”).

Please be informed that your Personal Data may be disclosed to our affiliates, service providers and relevant business partners such as public relations agencies, market research firms, advertising agencies (if any) for the Purpose and as permitted by applicable data privacy laws. In addition, you will appreciate that we are part of PharmaCare (Asia) Sdn. Bhd. which operates in multiple jurisdictions. Accordingly, access to the Personal Data may be granted to other entities within the PharmaCare (Asia) Sdn. Bhd. and may be transferred out of Malaysia for their processing of your Personal Data for any of the foregoing Purposes, if required.

You may request access to or correction of the Personal Data or limit the processing of the Personal Data at any time hereafter. Please note that it will be necessary for you to provide all of the Personal Data, without which we will not be able to process the same for the Purpose including our obtaining your feedback. By submitting your Personal Data for this Contest, you consent to the processing and transfer (if required) of your Personal Data by us.
